Wellbeing 4 me Pty Ltd (ACN: 669 359 522) is Renée and Iain McDonald’s company. This website is all about the application (app) and wellbeing clinic that we offer to the world.

Please take a moment to read them, as they set out your important rights and obligations and Wellbeing4me™’s commitment to ensuring clarity about where we both stand. When you visit this website www.wellbeing4me.com, you agree that you are over the age of 18 and you are willing to be bound by these Terms and Conditions. If you do not accept this agreement, you should not continue to visit or use the website or purchase from us.

All products and services advertised on this website are offered in compliance with Australian Consumer Law and are provided by reputable professionals with leading industry knowledge and skills.

 

 

General Disclaimer

On this website, you will find content regarding health, wellness, wellbeing, mental health, spiritual wellbeing, and associated work. This website is designed for Wellbeing4me™ clients, consumers, and practitioners only. If purchasing services from Wellbeing4me™ clinicians, it’s important to note that we cannot guarantee outcomes with any practitioner.

If buying, purchasing, or consuming any services from Wellbeing4me™ practitioners, you are required to do your own due diligence. This means, please do your own research and check out the clinician before booking an appointment. Choose wisely. We cannot advise you on whom to choose, and we cannot guarantee any health outcomes or provide specific guarantees. While we can assist you in finding the best practitioners, it’s important to listen to the advice and suggestions of your chosen practitioner to achieve the best results for your health and wellbeing.

The information on this website is provided solely for you—as a client, or for your practice or the company you work for.

 

 

Mutual Consumer and Business Rights & Responsibilities

As a business, Wellbeing4me™ has the obligation to provide you with quality services to meet your needs, as much as we can.

Wellbeing4me™ takes this very seriously.

At Wellbeing4me™, we check that our practitioners have the right to offer you the service that they are advertising. Beyond this point, we cannot guarantee your outcome. Therefore, it is essential and your responsibility that you check the credentials and details of the clinician that you have booked in to see (regardless of whether you are seeing them via video conferencing or in-person at our clinic, or another clinic of the practitioner’s choosing).

We aim to provide practitioners to you, the consumer, of a high standard and we do check the details of all our practitioners. It is essential for you to be aware that Wellbeing4me™ does not provide indemnity or insurance for any of our practitioner members on our application (app). Each practitioner is required to have or hold their own insurance as the outcomes of their treatments with you, the client, consumer, or patient, are the responsibility of the individual practitioner and yourself as the consumer of our application (app).

You have the right to receive quality health, wellbeing, and wellness services and can complain or provide feedback accordingly. If you were dissatisfied with your session, please consider leaving a ‘low star review’ for that clinician. This feedback will assist other consumers in making informed choices in the future.

Generally, the pricing structure with Wellbeing4me™ is about the application and clinic appointments to be booked for free, especially when using the application (app). The cost to you, the consumer, will be when you formally book the practitioner and arrange an appointment. The practitioner may have a cancellation policy. Please check their cancellation policy prior to booking, as you may have a fee attached to your booking if you do not show up to your allocated time. Please be respectful of your time and the practitioner’s time.

If you organise a ‘live free 15 minute chat’ (session) with your chosen practitioner, you can arrange this for free for the first 15 minutes. After this, you will be charged by the chosen practitioner. Please be appreciative that the practitioner has supplied some of their time to you and be respectful and either arrange a professional booking and/or decide on not going through. The practitioner is gifting you their time when they could be seeing other clientele, consumers or patients. 

It does not offend a practitioner to know a yes or no answer. We would appreciate that you do not waste the app time you had, or the practitioner’s time – so choose wisely and arrange a time with your chosen practitioner as soon as you have made your decision, based on your contact with them.

To the best of our ability, we endeavor to provide you with high quality client services and up-to-date skills for the marketplace, as long as it is humanly possible.

Due to the nature of the changeability of the information technology era, Wellbeing4me™ will do their best to be cutting edge with its offerings, though cannot possibly predict what is the next trend.

Therefore, it is your responsibility to check out the practitioner and to work out if they’re right for you. Wellbeing4me™ cannot be responsible for the outcomes of your health journey. It is not Wellbeing4me™’s responsibility to implement the outcomes for you.

Unfortunately, not all people have the same results equally from their chosen therapist, practitioner, wellbeing or health professional.

Wellbeing4me™ and the team at Wellbeing4me™ have the right to refuse service to any professional or consumer at any stage at any time and we also have the right to refuse practitioners using our service, or listing, based on their professionalism, or any complaints that may have happened.

In so far as we can, we endeavor to be flexible to meet your needs. If you are attending a pre-arranged live chat, it is your responsibility to attend. It is not Wellbeing4me™’s  responsibility to change times for you.

Wellbeing4me™ Clinic and the App has a limited capacity to offer internally counselling and coaching services to practitioners and consumers. The majority of practitioners available on the Wellbeing4me™ app are available externally to Wellbeing4me™ and are contractors and members of the Wellbeing4me™ app. We cannot provide ongoing therapy, or health supports to the general public beyond what is externally offered within the application (app).

*Free 15 minute live chat session – terms and conditions*

If you have requested a free 15-minute session through our application (app), through chatting to your practitioner, there are a number of terms under which this free service is offered. Free 15-minute live chat sessions are subject to restrictions – and the Wellbeing4me™ practitioner needs to be able to determine whether or not that they can assist you. If you choose to chat for longer than 15 minutes, you will be charged for your time with your practitioner. Consumers of the app (clients, patients or customers) are only supplied with one free 15-minute live chat session at the time of log on, on a one-off basis, prior to the commencement of your time with your practitioner. If you book a session with your chosen practitioner, this time will cost you money – and that will be determined with your treating practitioner.

Wellbeing4me™ The App is not a health-based service; the App is a health and wellbeing-based directory that assists you in finding the right practitioner. Please make use of the free live 15-minute chat with your chosen practitioner, to determine whether or not you would like to utilise their services. It is buyer / consumer beware on our application (app) and we cannot guarantee your outcome with your practitioner. It is up to you to ‘do the work’, or take the medications, or take the advice of your treating clinician, practitioner or professional. Wellbeing4me™ cannot offer you direct advice on who you should choose as a practitioner, or what choice you should make.

If you are undertaking utilising our app, you understand that you are a human adult capable of making decisions for yourself. We aim always to do no harm and to provide good services and to do good for our consumers using our app. Please ensure you take responsibility for your choices on our application (app).

If you are unsure, or uncertain, please contact the Wellbeing4me™ team for more details – as we cannot provide you direct support without hearing your individual concerns or query.

Finally, free 15-minute live chat sessions can only be provided within our application, they can’t be provided outside of our application.

Visitor Responsibilities

If you are a website visitor, your responsibility is to ensure the information you gather might suit your needs. There are other services like Wellbeing4me™, though Wellbeing4me™ is unique in its ability to provide a flexible therapeutic, coaching, wellness, wellbeing, health, or professional service. If you do not obtain what you need from this site, we would encourage you to either search for further information on Google, or contact us directly. We may be able to assist you further or know of somewhere we could refer you to – if we cannot assist you with further services.

It is your responsibility as a visitor to this site to not share the information contained in this site to other parties. Wellbeing4me™ may mention these other entities as they form the sum total of Wellbeing4me™ business ventures.

If there are third-party advertisements, all practitioners and potential practitioners will be informed regarding the product, and the benefits of the product, and of the potential for conflict of interest.

Your Responsibility

Wellbeing4me™ is not a registered health provider, so we cannot guarantee that our services will fit every need of yours. Please choose the service you need wisely. We will not refund for each and every person’s change of mind.

Your responsibility also lies in being assertive and ensuring you are getting what you need. If you don’t advise of your needs, we may not be able to attend to them. Please be in touch with us to ask us questions about each service to ensure it will suit you.

If you have a problem, or any issue whatsoever, please contact the Wellbeing4me™ team. We will endeavour to sort out the problem. If it is a problem of therapy, coaching, or services cost, or issue related to any services, this may not be able to be changed. Please ensure you continue open communication in order to limit the future problems.

It’s important to not doctor any work that you find on this website and all information must be attributed directly to Wellbeing4me™ and used as is.

Information can be used from this website for personal and business reasons, though not shared on to any other businesses or for your own commercial purposes, as stated above. None of the information on this website can be claimed to be direct health, wellness or wellbeing advice.

Payment Terms

Wellbeing4me™ accepts direct deposit transfers and credit card payments through stripe and new digital gateways, like crypto payments. Please ensure you are up-to-date with your payments to your chosen practitioner. Wellbeing4me™ ensures the professionalism of their service by asking for a percentage of the transaction fee and membership fees, from the professional practitioners – in order for the practitioner to list on our service and application (app).

Payment Plans

Payment plans can be accepted for practitioner membership only. Any payments directly paid with a credit card, cannot be added as a payment plan. Please contact Wellbeing4me™ directly regarding payment plans, especially in the case of hardship.

Security Policy

For more about security and your privacy, please see the Wellbeing4me™ Privacy Policy. It is suggested that all consumers and practitioners of the application (app), or in our clinics, to obtain a VPN service to ensure your safety, privacy and security. Your safety and privacy is our top priority.

Delivery

Currently, Wellbeing4me™ does not distribute any physical products, therefore physical delivery of products is not applicable for Wellbeing4me™ services.

Delivery of any services is electronic, and it is expected that you have the necessary WIFI services connected, or ability to access the internet in order to take part in Wellbeing4me™ services. 

All free information sheets require internet downloading capabilities.

Shipping

Shipping does not apply to Wellbeing4me™ services, as there is no physical product delivery, as mentioned above.

Returns Policy

Wellbeing4me™ services includes paid sessions with practitioners, one-to-one live chat with practitioners and general information about the practitioners who choose to list with this service.

Wellbeing4me™ provides free information sheets, and referral within all of Wellbeing4me™’s related services.

Wellbeing4me™ will only be able to provide refunds in extenuating scenarios only. If you have a change of mind, we cannot refund your purchase with your chosen practitioner. Please contact your practitioner for a refund directly – as once the transaction has occurred, we distribute monies to this practitioner. We therefore cannot ever assure you of a refund, unless it’s deemed appropriate with the practitioner. All professional practitioners on our platform will have a cancellation fee, be sure you check in with your chosen practitioner the details of their cancellation terms.

Order Fulfillment Policy

If, at any stage, we cannot fulfill your order or if the service is discontinued, we cannot guarantee a refund of any monies paid directly to your practitioner of choice. Special note: Buyer / consumer beware. Your responsibility is to make sane and sound decisions and choices regarding your practitioner. Please do your due diligence and research regarding a practitioner and their capability of attending to your needs and requirements. Only you will know if your practitioner is supportive and providing the best possible service to you, their client, consumer or patient.

Change of Mind

In general, we will not issue a refund for a simple change of mind.

If you accidentally choose the wrong service, and you contact us directly, due to a technical error, we can issue a refund, though this is at the Wellbeing4me™ owner’s discretion.

Consumer Guarantees

Our consumer guarantee links to how we can make things right for you. Australian Consumer Law contains built-in customer guarantees. At Wellbeing4me™ we consider it important that we apply these laws in practice to all of the training and services we offer to you.

Minor Problem

A minor problem is something that can be easily fixed. It might mean that you wanted a different service to the one you have signed up to.

We at Wellbeing4me™ pride ourselves on being able to resolve your minor problems.

If you have a problem with any of our free content, please contact the Wellbeing4me™ team and we will get the information to you as quick as we can.

Major Problem

A major problem relates to where there is a problem that cannot be fixed or is too difficult to fix.

This might mean where if you had have known in advance, you may not have purchased the service. To the best of our ability at Wellbeing4me™, we endeavour to meet your needs, though we are not an all encompassing service.

You are not entitled to a refund if you have not done your research and have purchased the goods or services provided by Wellbeing4me™ and our associated practitioners offering the services to you, without proper care from your decisions. If there has been human error, this may have been out of our control.

We will do our best with good will to attempt to supply a credit to you for other services in the future if something is extraordinary that happens that is something that we cannot control.

If you are unhappy with the outcome, you are entitled to take further action, though this needs to be after you have contacted us directly.

Specific Terms of Sale

The specific terms of sale are specific to the health and wellbeing consumer and/or the practitioner. Wellbeing4me™ cannot assist you with your decisions or choices of practitioners. Please look in to each practitioner’s professionalism, reputation and client/consumer/patient outcomes. 

If you are issued a refund for any reason, you need to pay attention to all of the information above and contact the Wellbeing4me™ team for more.

Respectful Communication

It is important to engage in respectful communication at all times with the Wellbeing4me™ site and Wellbeing4me™ personnel, Wellbeing4me™ staff and stakeholders. All blogs on the Wellbeing4me™ site are turned off for comments due to the private and sensitive information related to the counselling, wellbeing, and/or health-related consumer clients that many Wellbeing4me™ clients may serve.

All email and written communication must be respectful at all times to Wellbeing4me™ staff or stakeholders. Respectful communication is at the forefront of how Wellbeing4me™ operates, therefore we will delete any rude or inappropriate comments written in any media – social media or on our website as it may tarnish the Wellbeing4me™ brand.
Please ensure you bring any issues directly to the attention of Wellbeing4me™ in order for us to remedy any problem you may have.

Responsible Engagement

Wellbeing4me™ participate in Facebook, LinkedIn, Twitter, Tiktok and Instagram posting. We would hope at Wellbeing4me™ that there was respectful engagement in any social media groups that Wellbeing4me™ runs and the rules of engagement are that comments will be deleted if they appear to be disrespectful and/or inappropriate to any member of a particular group.

Wellbeing4me™ takes social media commenting seriously and ensures that we remain professional and friendly in our dealings with the general public. It is then essential that our clients and users of our services will ensure they do the same.

Wellbeing4me™ takes no responsibility for the behaviour of others on any platform that we run. We will do our best to resolve any problems at the time, though some behaviours from others may be difficult to manage and we take no responsibility for that.

Such behaviour may mean a participant is asked to leave a social media site, or the whole application (app) that we run. Wellbeing4me™ can ask anyone to leave their services at any time, though we will endeavour first to talk directly to the person, or people, involved in order to get the best resolution for everyone.

Jurisdiction & Dispute Resolution

Jurisdiction

Wellbeing4me™ is located in New South Wales (NSW), Australia. This agreement is subject to the governing law of NSW.

Negotiation

If you have a complaint arising out of your use of this website, or these terms and conditions, you and Wellbeing4me™ agree to make a genuine effort to resolve the dispute through negotiation and discussion.

Mediation

If we are unable to resolve a dispute by negotiation and discussion within 14 days, the parties must proceed to mediation with the assistance of an accredited mediator, who is independent of the parties. The mediator is to be appointed by the agreement of the parties or, failing agreement within twenty-one (21) days of the first notification of the dispute, by a person appointed by the Chair of Resolution Institute, (ACN 008 651 232, Level 2, 13-15 Bridge Street, Sydney NSW 2000; telephone: 02 9251 3366, email: infoaus@resolution.institute) or the Chair’s designated representative. The Resolution Institute Mediation Rules shall apply to the mediation. We agree to share the costs of the mediation equally between us.

Litigation

It is a condition precedent to the right of either party to commence litigation that we have tried dispute resolution. Litigation is to be considered a last resort and may not be commence until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted. In other words, this means that we agree not to go to court until we really tried our best to work things out, and the mediator agrees that we cannot resolve this on our own, so we will need a judge to make the decision for us.

In addition, we are also a professional listing and service – if you are a practitioner. I appreciate the time it has taken to find us and to figure out whether or not you can come to us for trusted professionals.
